Occupy Sydney fully support Aboriginal elders opposing the imposition of short term extractors rights over long term maintenance of ecological balance in this most fragile of ecosystems.

The 24/7 Homeless Hungry & Cold Peoples Resource

  Occupy Sydney came into being as a platform for the 99% to confront Corporate Greed.
  Each time we looked across Martin Place another homeless person walked by. Homelessness is the collateral damage of Corporate greed. And it would be utterly remiss of us to carry on a cinversation addressing Corporate Greed without supporting those  most affected in our siciety. It is unacceptable that a land so rich in resources would allow so few to take for themselves so much disposessing so many in the process.

Occupy Sydney remain defiant as City of Sydney steal Homeless Resources for the Fourth Time

Defiant Occupiers and the Homeless Community are again rebuilding the Occupation and Sydney Homeless Hungry and Cold Peoples Resource following the 2pm raid today on the Occupy Sydney Occupation.

 Until the Occupy Sydney Occupation began feeding Homeless People 24 hours 7 Days a week the City of Sydney made no effort to end the Occupy protests. In fact Mayor Clover Moore denied that police were victimising Occupy Sydney on Council orders. Within days of this Occupy Sydney initiative commencing Corporate servant and Federal Politics aspirant Councillor Christine Forster saw her opportunity to use the eradication of Homeless people from Corporate Sydney as cobblestones on her pathway to federal politics. Mayor Clover Moores team of Fence sitter team and other closet Liberal councillors happily supported her.

 City of Sydney do NOT consult with Homeless people. They have a Homelessness unit whose last 2 managers Liz Gyles and Felicity Reynolds are ex poverty industry powerhouse Mission Australia employees. We know of no services provided by or on behalf of City of Sydney which provide walk up 24 hour support to homeless people.

 Angry Homeless Community members are outraged that The City of Sydney ,awash with Millions of Dollars and culpable for causing homelessness has not in decades thought to establish a place where they can get food hot drinks and blankets 24 hours a day. Unlike any of the Poverty Industry operators, many of the Homeless Community willingly contribute monetarily and in kind to the Occupy Sydney Resource because they value the ability to eat when they are hungry and get blankets when theirs are wet or gone. 

  Occupy Sydney remain committed to preventing the City of Sydney effecting its NIMBY plan to eradicate Homelessness in the City by starving homeless people out or forcing them to live in Jail-you-pay-for institutions like Common Ground.We will again rebuild and be feeding our Homeless Community Friends by tonight.City of Sydney have not once fulfilled their legal obligations to

 Angry supporters are also outraged at what they describe as "The Fascist actions of City of Sydney". Chalkupiers are threatening to exchange chalk for spraycans. Others are calling for the city to be turned into an eyesore by the simple act of tipping rubbish bins onto the streets. While we cannot endorse these actions we share those supporters outrage and fully understand why they might be driven to do these things.

 The City of Sydney has never held meaningful discussions with Occupy Sydney preferring to dictate what we should do through Nazi like jackboot diplomacy

Rebuilding following the Third July 2013 Eviction of Occupy Sydney

  Around 8-30 am today Tuesday 9th July City of Sydney workers led again stole assets Occupy Sydney are using to operate our 24/7 Homeless Hungry and Cold Peoples Resource Centre from Occupy Sydney in Martin Place. 
  • If we do not reestablish then tonight Sydney's Homeless Community will have nowhere to go for Hot Food Hot Drinks and warm blankets. We will not permit the City of Sydney to meet its admirable 2017 objective by simply starving the homeless out of Sydney.
  • 24/7 Homeless Hungry and Cold Peoples Resource Centre needs a barbecue brought in.
  • 24/7 Homeless Hungry and Cold Peoples Resource Centre need bacon sausages and eggs.
  • 24/7 Homeless Hungry and Cold Peoples Resource Centre  need 2 large pots.
  • 24/7 Homeless Hungry and Cold Peoples Resource Centre need a gazebo or marquee.

Police have now stationed the Rocks Police Command Post at Occupy to prevent us re-establishing. We are already rebuilding at another location which for security purposes we are not publishing. It is being spread around the Homeless Community now.



Angry supporters have already vowed to substitute the usual chalk used in the Occupy realm with spray paint and other more permanent expressions of their outrage

 Others are calling for unwanted furniture to be left on the side of the road in City of Sydney for collection by Occupy Sydney reconstruction team.

City of Sydney Out of Order

For 20 months The City of Sydney Council raised no objection to the Occupy Sydney 24-7 protest in Martin Place.

 Liberal Councillor and sister of Opposition leader Christine Forster was elected eight months ago. She has never raised the issue of the Occupy Sydney Occupation in that time.

 On May 13th 2013 as the beginning of a proactive campaign to end homelessness and deliver housing affordability Occupy Sydney launched The Homeless Hungry & Cold Resource Centre serving Hot Food and Coffee 24 Hours 7 Days a week. 

 On June 13th Councillor Forsters article in The local Murdoch Press rag alerted us to the fact that she had tabled a motion in council calling for Occupy Sydney to be evicted using Police Force if necessary.

 On 24 June Council on the flawed information given by Councillor Forster and over the objections of Greens Councillor Irene Doutney and Labors sole representative Linda Scott, the Council passed the resolution with a conscience appeasing fence sitting resolution to evict Occupy Sydney.



 Occupy Sydney's preliminary legal advice is that Council have not issued proper notice. As the matter is civil the Council require Court orders to effect their process. Police have no power to intervene.

 Instead of which The Council have selected to act illegally using armed police as thug stormtroopers to threaten intimidate and nullify Occupiers ability to protect Occupy Resources.

 The Occupy Sydney Constitutional Challenge recently lost by Occupy Sydney is being appealed.This case tested the heirarchical priority of protest vs regulations not the validity of the regulations themselves.
 The Supreme Court case ordered appealed by the NSW Premier , did test validity to some extent and this case was won by Occupy. The DPP has filed notice to appeal but not filed an appeal as yet.


 We believe that the real reason Council has passed this eviction resolution is to deny Homeless people access to appropriate resources to provide for basic human need. Warmth Food and Shelter. Councils Homelessness unit enjoys a healthy relationship with some of the most toxic monetisers of marginalised people in Australia including Mission Australia operators of the "jail you pay for "Common Ground" so glowingly lauded by another monetiser, Therese Rein.The Homelessness Unit cooperated locally in a callous Federal Government initiative to dump Mental Health Health System Clients onto the Streets and prioritise their access to "homeless housing". The Councils delivery agency Neami had 25 years of Mental Health case maintenance expertise but zero experience with homeless. Many of the homes the public is being told are housing Homeless people are housing these people wilfully made homeless by Federal and State Governments deliberate policy.

  Council has given Occupy Sydney no timeline to leave.

 Yet in a crass display of arrogance and disdain for legal process or Civil Liberties Council arrived unannounced on July 3rd and commenced stealing Occupy Sydney resources aided and abetted by armed State Police.
  Occupiers scrambled to restore services to our homeless community. A mobile kitchen was brought in before the site was restored.

  On 5th June City of Sydney who had approved a film crew shooting ABC TVs Rake program to shoot in the area again raided Occupy Sydney assisted by armed and actively engaged NSW Police whose well known thuggery was brutally to Occupy supporting wheelchair using aboriginal elder Colleen Fuller who needed hospital treatment.

 Police physically wrested a barbecue another occupier was attempting to place in her vehicle from her posession causing injuries and lacerations which did not require treatment.

 Occupy Sydney absolutely deplore Council initiated police thuggery towards Colleen and other Occupiers. The use of the police to preemptively usurp the rights of peaceful protesters and proactivists without prior reference to Courts amounts to arbitrary and selective application of force to effect government desires whether legal or not.

 The choice of police to act as they did in the second raid amounts to another instance of arbitrarily applied state terrorism and should be absolutely rejected.

Occupy Sydney: Council Eviction meeting: The aftermath.

  For 590 days City of Sydney Councillors did nothing. But when Liberal Councillor Christine "Eyes Wide Shut" Forster belatedly noticed that Occupy Sydney were feeding and supporting our Sydney Homeless community 24 hours a day with a zero funding base and doing so successfully the thought that the credibility her beloved parasite charities which get so much funding for so little value to their identified target constituencies being undermined  was too much. Armed with a bevy of mainstream media  mogul owned Talkback spindoctors and faux journalists who never let the  truth get in the way of a good Mainstream political beatup Councillor Eyes Wide Shut was in her element. She could bash those Occupiers who dared with no resources to do 24 hours a day what her beloved funded charities which give politicians who do nothing such glowing endorsements do for as little as an hour a month. She could declare that Occupy was not a protest.The mere fact that the absurdity flowed from her Liberal endorsed tongue would give sure fire credibility and media regurgitation would make the illusion reality. Again the Conservatives would have effected a win for their patrons in the Corporate sector-in this case those who monetise the marginalised. And those pesky protesters who really should be working as wageslaves in a minimum wage job to drive profits for the fatcats who fund the party could be exposed for the frauds they really are- malcontents who pretend to find Corporate Greed distasteful.

  Most Councillors luxuriated in the comfort of chambers to arrive at conclusions most would not have reached had they ventured out in the cold wet winter night as urged by Clr Linda Scott (Lab) to see for themselves the Sydney Homeless Community come out with Occupiers to support Occupy Sydney at the No Eviction barbecue.

Australia's First 24 -7 Homeless & Hungry Resource Centre
  Despite National annual expenditure by Federal State and Local Body Governments in the name of Homeless People
Occupy Sydney Homeless Resources 24-7
we have yet to identify another service where Homeless People can simply walk up and get free unconditional food drinks blankets and clothes- essential items when one is homeless and freezing at 2am on a Sunday Morning.
 The Occupy Sydney Homeless and Hungry Resource Centre now opens 24 hours
A day 7 days a week serving hot food providing free clothes blankets and sleeping bags when available. The Kitchen has in the last two weeks provided over 5000 individual services. About 600 kilograms of food was disbursed just over the last weekend.About 320 Blankets or sleeping bags have passed through the Centre along with at least 1000kgs of good quality clothes.

 The Resource Centre is 100% funded by public donations which can be made at the site or by calling/texting 0410722000 24 hours a day.

 We and our homeless community friends are deeply indebted to the generosity and kindness of the many members of the public and Occupy Sydney Supporters who have and continue to support this vital community service.

   The City of Sydney is being asked by opportunist Councillor Christine Forster (sister of Federal Liberal/Coalition leader Tony Abbott MHR) to evict Occupy Sydney. Photos of her being interviewed by media nearby give the strong impression that she has seen the Homeless Resource Centre which shares the Occupy Sydney Protest site. While the councillor mistakenly describes the Protest site/Homeless Service facility as a camp, the Councillor does draw attention to the fact that there is in fact no Camping site for Homeless and Transient people in Sydney -and perhaps there should be. This will doubtless be part of the discussion at the Meeting at Occupy this Saturday (22 June) from 2pm which will informally discuss Homelessness solutions .

  Sydneys First and Australias only known 24 hour 7 day Homeless Resource Centre is now fully operational.
The Occupy Sydney Homeless and Hungry Field Kitchen & Freestore is now in full swing at the 600 plus day old Occupy Sydney Occupation in Martin Place (corner of Elizabeth St.
  There is always a FREE hot drink and usually a hearty soup available 24 hours a day. Other donated food is distributed immediately it arrives. Bakery, shop end of shelf life food and fruit are available as they arrive. More is needed and welcome.
Occupy Sydney distribute blankets and sleeping bags on an as needed basis and more are always needed.
  Unwanted clothes and non technical "timeless' bookd are always welcome for our Freestore (open 24/7) and soon to be resurrected peoples library.
  Each year hundreds of millions of dollars of taxpayers and donors funds are collected by the poverty industry in the name of homeless people.The same government and ngo organisations have for decades used the issue as a means to generate revenue. Revenues organisations and government departments have expanded massively. So has the problem as housing and associated costs become less affordable.
  An occupier with some experience of the marginalisation industry has observed that there is no plan will or intent by government to resolve the problem. He accuses government and the Sector of callously using homeless and marginalised people as tokens to collect money with, cynically cycling them through a circuit of monetisation opportunities before spitting them back onto the street to start the process again.

Rather than joining with those who monrtise homeless people Occupy Sydney are joining with the Sydney Homeless and supporters community to drive sustainable solutions to this problem which should not exist in a place so rich in resources.

Hey Folks WE WON, Woodside will no longer be building a massive gas hub at Walmadan. However there is a great big country still waiting to be saved, and now we know we can win.

This convoy is now taking to the road to visit all those precious sites around our awesome country still threatened by greedy mining compaines. Major focus' will be on CSG, Uranium and saving the Burrup Peninsular from further damage, and fighting for it to be World Heritage listed.



We leave to protect part of this ancient land first walked upon 130 million years ago by dinosaurs who left their prints, then walked upon, loved, cared for and respected for at least the last 40,000 yrs ago by the original inhabitants of this land, a history of culture, country and tradition that still lasts and is very strong amongst the Goolarabooloo people today.

This is all under threat for short term gain. Woodside alongside their joint venture partners and the West Australian Govt are hell bent on destroying this legacy of our world's history for 5 decades of gas flow and a few billion $$ for their company shareholders and executives. By building the world's biggest gas hub right in the middle of Sacred Aboriginal Ground.

The Campervan will be launched at a Special event in Newtown on April 17th from 4pm till late.

Occupy Sydney Constitutional Challenge Falls Short


We didn't succeed in our Federal Court case.
Also the Court has allowed the City of Sydney Council to make an order for costs against our applicant. 

Eamonn or I will let people know what the Council ask for (in the next few days/weeks).

Eamonn will also speak with the lawyers regarding the potential for an appeal to the High Court. HUGE UPS to Eamonn of course through all this!!!

- the matters had been consistently adjourned pending this decision. The hearing dates for the group trial will be set on 6th June 2013
- we should all definitely chat before then regarding any questions, any possibility of a High Court appeal etc

- a brief summary of the decision is as follows:

Essentially there are two parts/limbs to the legal test for determining whether the implied freedom of political communication is impermissibly burdened:
1. did the law effectively burden communication about govt/plitical matters; and
2. the 'proportionality' test - is the law reasonably appropriate and adapted to serve a legitimate end of representative and responsible govt.

The court found that we had proved the first limb.
The court denied that we had proved the second. The court found that the Council's prohibitions on camping or staying overnight served a legitimate end being "maintaining public health, safety and amenity in a high use public area and preserving the ability of all members of the public to use the area"
The court found that the Council's prohibitions were reasonably appropriate and adapted to serve the above end.
(We had anticipated that this would be the reason in any negative outcome for us.)
All in all, a disappointing outcome of course. Onwards.

Its an absolute mystery to aware Australians that Prime Minister Julia Gillard would apologise to the Forcibly Adopted Stolen Generation of times past ignoring that the practice never stopped.In fact in NSW Current Government policy is to provide an express queue for the Buy a Kid Crowd. See Here.

An open letter to Prime Minister Julia Gillard,
Dear Ms Gillard,
                 While there are those born between the appropriate years for which you apologised regarding forcible adoptions who are grateful for your apology we note there are many flaws.
1/ As a legal professional you would be aware that your apology carries no legal weight. 
2/ Your apology lacks the commitment to reparations for the harm done to the Children and families of that era.
3/ Did you fail to notice that the practice of forced adoptions in fact never ended? There are currently 39000 Children in Out of Home Care in NSW. They are taken PRIOR TO JUDICIAL PROCESS by an out of control Human Services Department which have masqueraded for decades as acting in the best interests of children-the same lies which caused the adoptions you just apologised for.

There is something you can do. You can end the travesty of State Child Abduction in Australia. You can Federalise responsibility for Child Protection AND Shut down all State Child Protection Services. You can introduce TRANSPARENCY to the New Federal Child Protection Agency by insisting on video recordings of all interviews with Children Parents and professionals in relation to each case- AND- you can introduce laws which apply the Evidence Act to all cases. Yes, they should be heard in the Federal Family Court-after a revamp. 

To enact these changes may absolve a future government of the burden of making an empty and meaningless apology as you have just done,

So here it is. The Stop T4 Rally and Street Parade is this Saturday. To make it a huge success we need you ! We really hope you’ll be there on Saturday and that you’re bringing your family and all of your friends. It’ll be loads of fun and a great opportunity to hang out with awesome people but in terms of its persuasive power, it’s the sheer number of people in attendance that will make a difference. Your presence on Saturday will put pressure on key decision makers. Come and be counted. The rally follows the release of the 'Coal Dust in our Suburbs' report. The report shows houses in Newcastle and the Lower Hunter are exposed to particle pollution levels well above the national standard and high enough to cause asthma, respiratory and cardiovascular impairment, hospital admissions and premature death. If approved, T4 will be a public health nightmare. The rally will call on the NSW Government to reject T4 because of the unacceptable risks T4 poses for community and environmental health. Legals: Constitutional Challenge & Oct 23 charges update

Recent developments People may know that that decision came down on 27 February. The decision was not the favourable decision for our case (found for the Council in that case). On the same day the High Court released its decision on another case, the "Monis" case, that also considered the extent of the right to freedom of political communication. The court was evenly split so the previous decision of the lower court was upheld, being that Monis' appeal was unsuccessful: Monis unsuccessfully appealed charges against him on the basis that the law under which he was charged was not compatible with the implied right to freedom of political communication. Essentially, the High Court decisions are not immediately helpful to our case as both decisions did not amount to an expanded view of the implied right to the freedom of political communication. However, there are also numerous parts of the decisions that the Judge in our case may accept as relevant and supportive to our case. The lawyers have been working to make submissions to highlight the parts of the decisions that are helpful to our case, and to respond to parts of the decisions that may not be so helpful. The lawyers will make these submissions by today 15 March 2013. The Council will then respond by 29 March 2013. The Judge will consider the submissions and then hand down her decision at some point. Regarding the charges in the Local Court The Fed Crt case decision will not likely be before 4 APRIL 2013 when the 14 people with outstanding charges from OS will be back in the Downing Centre Local Court. If the decision is not handed down before 4 April 2013, as per before, unless anyone changes their mind about this strategy, the lawyers for the 14 people will ask for the matters to be postponed once more until after the decision comes out (as the Fed Crt decision will likely affect the charges in the Local Court). It is likely that the court and police will agree given that the Fed Crt decision should come out sooner rather than later, and given the numerous postponements to date. If the decision is made before 4 April 2013, Ramy, Eamonn and I will contact the 14 people regarding the decision and to discuss what people would like to do on 4 April.
