Government's and Corporations don't have a preference as to whether they bring it in through the front or back door...and they're trying to do it in secret. The front door is by signing the agreement. The backdoor is by bringing it in in piecemeal scraps of legislation scattered across Federal State and local body jurisdictions. Some of which will bang the door shut on our freedoms. 

Mandatory Data Retention will bring the TPP clause sought by Hollywood copyright holders through the back door if we let it. Under Mandatory Data Retention you will pay for your internet service provider to store your metadata for 2 years in case the government want to use it. There is nothing preventing government selling that invaluable metadata to any commercial interest should they choose to do so.

 Mandatory Data Retention is one of several laws which are on the table or already enacted which will put the TPP in place via the back door.

  After a hiatus in part triggered by City of Sydney's anti-homeless campaign against Occupy Sydney's Homeless Hungry and Cold Peoples Resource we have decided that following our exit from the program a clear gap in services exists- and in the absence of anyone else filling the void a new service #Occupy4Homeless will be launched early in 2015. 
 Recent enquiries among the homeless community in Sydney City elicited but one homeless person who did not feel our service is needed.There was otherwise unanimous support for our return. We are working on a new model which will deliver similar 24-7 food and resource services.
  The new homeless service will use our tried and tested crowd source method of raising resources but have some tweaks to services which aim to end homelessness.

 Our major homelessness strategy though focusses on an end result of "zero involuntary homelessness" -meaning no Australian resident who wants a home should be without one that is affordable. Affordable meaning costing 25% of income without subsidies. To achieve this in the long term will need a quantum shift in publicly driven policy. Short to medium term solutions can be brought on board with minimal delay providing immediate and autonomous shelter across most parts of Australia-our aim is an end to involuntary unsheltered living Australia wide within 12 months of inception.

End breach-of-promise: My 2015 New years wish

Everyone has a New Years wish, If this one comes true it will deliver a better future.

 My New Years wish is that every politician and candidate for Federal State and Local Body Elections be legally accountable for their promises- and required to cross the floor against their party if necessary- with laws which enable immediate removal of politicians for breach-of-promise.

 An election or any promise by a politician means absolutely nothing when upon election they can just do what they like without consequence. All the parties in the world will not fix this. And it is the absence of harsh legal penalty which undermines democracy.

 In the current political paradigm in Australia politicians can promise the earth and deliver the contents of the toilet bowl -without penalty. You have witnessed a round robin of politicians who have done precisely this.

 On the 1st of Jaunary 2015 a simple contract will be sent to every current politician in Australia. It will invite them to sign a pledge to endorse the introduction of this as Federal law. It will be retrospective to 1995. Under this proposed law offending politicians will risk losing all their assets as well as serving jail time.

 This should be the basis of democracy.

 A simple question and answer form will accompany the mail-out asking representatives to take a stand on some issues of concern as a contractual agreement with their constituents. Their answers or failure to do so will help you choose who you will vote for at the next local body, state and federal elections. The Queensland Government have named 24 organisations which happen to be mostly biker clubs as specific targets. The legislation does NOT limit the scope of these laws to bikie clubs.

  South Australia and NSW have already tried to implement similar laws; both were laughed out of the highest courts.

At the most recent state heads of government meeting agreement was reached to apply these draconian and selective laws uniformly in most if not all State and Federal jurisdictions.

  Queensland is for now taking the lead in rolling these laws out.  The Newman government with its landslide victory at the last Queensland elections do not have to negotiate with an oppositional Senate or for that matter with any meaningful opposition. They can and do simply ram legislation through Parliament treating their majority as a licence to treat others with 
scorn indifference and injustice. There is no injustice of more concern than the selective application of laws. The resulting absurdity of a Father and two sons, members of a "declared organisation" being liable to Criminal prosecution for going shopping together epitomises the phrase "when injustice becomes law..." But the Newman government extend that rationale into the realm of Fascism.Not content with six months jail for the victimless crime they just created the Father ( a senior member) must also be jailed for a further 15 years  simply because he is a senior member of the organisation. 

  This is the reality in Queensland today and other States have either Similar Bills or enacted Acts or an intention to deploy them. 

   In 1853 a group of gold miners said "enough" of the expensive mining licences the British Colonial Government forced them to buy. The people stood with them en masse and the Battle of Eureka Stockade is indelibly etched in the proud annals of Australian political history. The battle was not peaceful- military forces were brought and some 27 people, mostly miners were killed. The miners won at Eureka Stockade because they stood up to injustice- and the people stood with them.

In NSW the Right to Silence became history in September this year because few stood and defended it. 

  Soon Anti Graffitti laws in NSW will outlaw chalking on footpaths and little children playing hopscotch will be committing a crime. 

 At Federal level government is negotiating the Trans Pacific Partnership with 12 other Pacific Rim countries in secret. We are not allowed to know what rights federal government are signing away. 

  For todays Australians the VLAD laws are what miners licences were to those gold miners at the Eureka Stockade. The notion that any law is intended to criminalise and selectively offends and discriminates so deeply that we all need to stand up in defence of freedom and in defiance of these laws. 

  When you ask yourself "Am I safe from VLAD Laws?" you should only answer "yes" when these laws have been consigned , along with Nazi-ism to history.

 Unions , political groups , political parties, even recalcitrant churches which disagree with government are under direct threat. With the recent sacking of the Chair of the Queensland CMC for criticising government as an in-your-face perspective of Herr Newman's tolerance of criticism .What message do you think impartial judges and politically "independent" bureaucrats took from that?

• ANYONE who speaks against Queensland government fascism faces a clear and present danger from the very government charged with protecting the people. 
• Potentially ANY group of three or more people can be subject to these laws without ever having been convicted of any crime based on the mere desires and spin asserted by politicians.
• Occupy Sydney are committed to standing with named 1%er Biker Clubs and members against the selective VLAD laws. Occupy Sydney are ready to stand with other organisations and groups as they are added to the list of declared organisations under #VLAD. Occupy Sydney stated in their media release "It is an absolute affront to the notion of equality which we value highly that any law and penalty would apply to some but not others within our society. Such laws, if passed, must be challenged dissented and disobeyed by the masses until destroyed and their instigators alone retrospectively subjected to the faux justice they saw fit to apply to others."

Those who find their holiday pay, superannuation and severance allowances have been chewed up as the company goes into liquidation wake up to the cold hard reality that the dream holiday they planned with family has turned into the nightmare that ripped the family apart ...despite everyone doing no wrong.

  Our research continuing from decades of earlier initiatives shows that almost $1billion annually is spent by Federal Government Nationally in the name of Homeless people. Once-were-Charities-today's Corporations at the forefront of wageslavery and undermining workers rights collect millions more. Homeless people have at best token input as to how that

funding is expended. The result is that the call for more funding is ever present. The "service providers" assets grow. The bureaucracy grows. The ministries grow. And the problem grows too. I'm sorry there's something fundamentally wrong with that picture and here at Occupy Sydney we've already pressed the reset button.

State Govt secures land for Kimberley gas precinct

Followng this announcement Occupy Sydney join the chorus of voices denouncing this dirty extractive play in this pristine but fragile ecological wonderland and the pittance paid to local Aboriginal Groups. There is well founded suspicion that far from merely facilitating the Browse extraction process this gas hub will be used to facilitate future onshore CSG extraction inland from Broome where preliminary testing has already taken place. 
 The Environmental assessments of this proposed Gas Hub to date are inadequate. Australian legal frameworks leave mitigation of spills or other environmental disasters as an after the fact consideration. Our current compliance regimes AND WOEFUL PENALTIES are so far behind Peru and Ecuador that Browse neighbour Chevron has shifted 1/3 of its Global revenue expectations to Australia in a case of Capital Flight from more ecologically concerned countries. Even if the extraction and logistics process were unproblematic there is the further issue of benefits accruing to outside interests in an area where sustainable local access to resources is marginal. We say "No Gas Hub=No way".  
  From Occupy Sydney we see a Government hellbent on enabling Corporate Greed over Sentient needs and to this we say "respect existence or expect resistance."

State Govt honours commitment to Aboriginal people of the Kimberley with $30million benefits package
The State Government has completed the acquisition of land for a gas precinct near James Price Point to support the development of nearby gas fields.

Premier and State Development Minister Colin Barnett said securing the land was an important next step in ensuring the efficient development of offshore and onshore gas in the Kimberley.

“It has taken substantial effort to reach this point, with the support of traditional landholders,” Mr Barnett said.

Under native title agreements reached with the Goolarabooloo Jabirr Jabirr native title claimant group in June 2011, the completion of the transaction has triggered a $10million economic development fund and $20million for indigenous housing.

“I thank the indigenous community for their courage in working with the State Government to secure this agreement and its associated social and economic benefits,” the Premier said.

Traditional owners will also have an ongoing role in managing the environmental, social and heritage outcomes of the precinct.

James Price Point was selected by the State Government in 2009 as the most suitable site from more than 40 locations, with the remote location minimising potential impacts on the community and the access to deep water close to the shore reducing the need for dredging and blasting.

“The Government is committed to delivering a project-ready site for the development of the region’s world-class gas resources,” Mr Barnett said.

The 3,414ha of land involved in this process is unallocated Crown land, over which no native title has been determined
All interests in the land have been acquired under the Land Administration Act 1997
In acquiring all native title rights and interests, the State has complied with its obligations under the Commonwealth Native Title Act 1993
Amounts paid to the $10million economic development fund and $20million indigenous housing fund are indexed to the Consumer Price Index in accordance with the Native Title Agreements
Most precinct land will be managed by LandCorp, with the port area managed and controlled by the Broome Port Authority
The land will be returned to the ownership of traditional owners at the end of the life of the precinct

•  Council staff member David asked that we "not make it personal" as his children were seeing it on Facebook. We suggest that this Council Worker cease and desist from carrying out the illegal orders of his bosses-and that they stop carrying out the desires of their Corporate masters and START LISTENING TO THEIR VOTERS.
• Council Staff member David stated that "we should keep it cleaner." Perhaps a fair request but for the fact that Council Steal our brooms dustpans bins rubbish bags. Occupiers and our Homeless community do everything we can to keep the area as clean as possible.
• On Council's apparent offer of negotiations, we are fair and reasonable people. The basis for negotiations will be for a) Council to cease and desist their theft of our resources.b) Council to make good all damage and removals costs including de-contamination they have done to resources previously taken. c) That Occupy Sydney 24-7 Homeless Hungry and Cold Peoples Resource remain at the current site near the corner of Elizabeth St and Martin Place AND continue to operate 24 hours a day AND continue to serve freshly cooked nutritious food to those who cannot afford it.
• Occupy Sydney's Position is Clear. The Council has no powers to prevent anybody giving away food. Occupy Sydney participants have (with one exception) NOT been served with ANY notice-a time sensitive requirement under the legislation which City of Sydney purports to enact. The Fact that after 23 Attacks not one Charge or violation notice has been issued invites the inference and empowers the assertion that THE COUNCIL KNOW THEIR ACTIONS ARE ILLEGAL but choose to use public resources to carry out illegal bullying attacks on a peaceful protest and homeless service in support of some Councillors desires.
• Council had ample time PRIOR to initiating attacks to negotiate and did not do so or make any attempt.
• Should Council wish to enter into discussions, Mayor Clover Moore AND Councillor Christine Forster are welcome to call (0410722000) and make an appointment so that PUBLIC and TRANSPARENT Negotiations can take place at the Occupy Sydney site. Other Council Officers welcome but negotiations solely with the instigators.

 C'mon , you hopped didn't you?? YES and you had fun...but now Big Bad Barry wants to erase hopscotch from the dwindling list of Freedoms you once enjoyed.When enacted these laws will make making chalk hopscotch squares a criminal offence. 

  We strongly suspect that the reasons stated in Parliament for "Strengthening the Anti Graffitti Laws": The "Major damage to Trains" -is mere spin to soothe the public. The real reason is to make visual communication the exclusive prerogative of those who can afford to buy consent- or those singing a song which keeps a subservient public singing along . 

 Occupy Sydney question these laws as unnecessary impositions on our freedoms.Freedom of expression (including but not limited to political expression) and of course the freedom to play hopscotch.... 

March Against Corruption and To Stop the TPP Sydney Nov 2 2013

  If you were on dry land with little risk and could not swim, would you willingly board a lifeboat which you knew was about to pull away from shore and sink? Would you also be willing to pay an undisclosed price to be on it with no destination route or reason?

 The Trans Pacific Partnership which the Australian and eleven other Pacific Rim Countries are considering signing FORCES you to do all of the above and more. The SECRET  negotiations (by elements of governments and transnational corporations} are known to the public only via a series of leaks.

 The Trans Pacific Partnership will give Trans-National Corporations such as Monsanto and Chevron (Caltex) the right to sue for compensation if a future government passes laws which inhibit their desired business strategy.For example Laws which place greater environmental protection responsibilities or exclusions on Extractive ( CSG , Tar Sands , Mining Logging ) operations. Or Laws banning Genetically modified cropping and the application of toxic Roundup.

 The Trans Pacific Partnership Agreement sought by Australia and the US will extend the life cycle and application of Patents and Copyright.

 In signing away YOUR RIGHTS and FUTURE GOVERNMENTS and CONSTITUENTS LIABILITY-WITHOUT CONSULTATION  the Abbott Government follows in the muddy footprints of the former Labor Government down a path of government by consultation ONLY with vested Transnational interests. 

 This is what Prime Minister Tony Abbott and the Labor Party before him want to commit you-and Future Australians to-

 the Trans Pacific Partnership could be an international agreement umbilically attaching Australia to the carcass of the dying US vulture. Heavily advantaging US based and other TransNational Corporations. 

Without government telling you what they are signing away -in your , your childrens and your future generations name.

This pattern of corruption of our democratic system that must stop, Governments are at the employ of their societies and must act on our wishes. It is time we took our place with Non Violent Direct Action, together we are strong, the more People the stronger the People Power. Our Position is VERY SIMPLE We DO NOT CONSENT  to secret deals made in our name. WE DEMAND TRANSPARENCY FROM GOVERNMENT  BEFORE - NOT AFTER THE DEAL IS DONE

NSW Dept of Communities -which as a reward for their incompetence in managing their Childrens responsibilities have been given Health Housing and Education -are The NSW State Terrorist Department beating countless hapless families into submission with powers Nazis wish they had- Courts where the evidence act doesnt apply- the ability to write reports without recordings and reinvent truth to suit their own state child abduction agenda. The Stand up for the Burrup Campaign advocate for the unconditional insitu preservation of the Oldest and largest collection of Rock Carvings in the World- At the Burrup (Dampier Peninusla) in Western Australia.In an unconsciencable act of heritage vandalism WA and Federal Governments have adopted an Eyes wide shut view as industry extractives and Shipping priorities have held sway over development of the area. The Burrup has only limited Protection at State level.It should be World Heritage listed. 

 Occupy Sydney have been a participant in the local element of this Global Campaign. Stand up for the Burrup have generously consented to production of a Special Occupy Sydney 2nd Anniversary Edition of their CD being released especially for the Anniversary - Stand up for the Burrup will have an onsite info desk.
